Fan Content Guidelines

We’re Studio Wildcard, the creators of ARK: Survival Evolved and the upcoming game, ARK 2 (“Games”). Every day we are humbled by the amazing content our fans produce. We love watching it, engaging with it, and helping to promote it, and we want to make sure that we’re always able to do so.With the upcoming changes to international copyright law, we’ve created these guidelines to help ensure that you have the tools and information you need to express yourself and engage with your communities with Fan Content using our intellectual property (IP) from our Games.
What is Fan Content?Fan Content is a term you’ll see being used a lot in these guidelines; it’s a term used to define things fans create using our Games or intellectual property. It’s pretty broad and can refer to many different things; what matters is that you’re following our guidelines set out below and do not misuse or misrepresent our IP.
Here is a non-exhaustive list of examples of Fan Content:

Videos & Livestreams (Let’s Plays, Walkthroughs, Base Tours, Building Guides, Clips, Reviews, etc.)

Fanart (Drawings of characters, creatures, artwork depicting/representing the IP, etc.)

Screenshots (including ones you’ve taken of your own gameplay and edited)

These guidelines only apply to IP and Games owned by Studio Wildcard.

These guidelines are for creating non-commercialized Fan Content. It is not intended to be, nor should be considered as, express permission nor an official license or authorization for you to create derivative works of our Games or IP.

These guidelines can and will be updated at any time and become legally binding once online and published to this page. The guidelines are not exhaustive, so we reserve the right to take down and, or deny any Fan Content or use of our IP at any time. This decision could be for any reason or no reason, including when we decide, in our sole and absolute discretion, that you are using our IP inappropriately. If we deny you the right to use our IP, you must stop developing, publishing, or distributing your Fan content immediately.
The Guidelines:

You are not permitted to imply or state that your videos are officially affiliated with, sponsored, endorsed, or approved by us.

You are not permitted to create Fan Content of our IP/Games that uses restricted content that is unavailable to the public. This includes but is not limited to Fan Content based on unreleased patches, NDA-restrictions placed on upcoming announcements, betas, alphas, etc.

You are permitted to use content from our IP/Games that has been officially released and is available to the public; this can include but is not limited to promotional materials, trailers, screenshots from announcements, etc.

If you want to use a third party’s intellectual property (e.g. music) together with our Games, you are responsible for obtaining any necessary third-party permissions.

You may create, upload, livestream, and monetize videos on online live streaming websites using our IP, but only using the authorized Monetization Methods (defined in the FAQ).

All Fan Content should be appropriate for the target audience of the Games. We reserve the right to take down anything that may not be suitable.

Do not use Fan Content created with our Game or IP in other games or products.

Fan Content used to promote or sell third-party programs used for cheating, griefing, or hacking our Games is strictly prohibited.

Please conduct yourself professionally and respectfully. We do not tolerate or permit Fan Content that is illegal, racist, sexist, prejudicial to sexual orientation, sexually explicit, disparaging, promotes hate crimes, or is otherwise offensive or harmful.

We reserve the right to remove any content that we believe is unlawful, infringing, inappropriate, harmful, or not in line with these Guidelines at any time.

What exactly are the "Monetization Methods" as referred to in the Guidelines?
Individuals can monetize their streams on services such as Twitch, YouTube, or other live streaming and video sharing platforms through partner programs/and or advertising as long as the Fan Content is available for free to the public on said platform. You may also collect voluntary contributions from your viewers as long as your video is also available for free to the public on YouTube, Twitch, or other video sharing services. As the creator of Fan Content, you are responsible for ensuring that you abide by the rules and regulations of the streaming service you are using when sharing Fan Content.
Under the Guidelines, can corporate entities create Fan Content using Studio Wildcard's IP?
The Guidelines are only applicable to individual consumers using Studio Wildcard's IP and Games. They do not apply to corporate entities. If you're a corporate entity, you are required to contact us directly for approval before using any form of our IP or Games in any way.
What do you mean by content that is "unlawful, infringing, inappropriate, or harmful"?While not entirely comprehensive and given for guidance only, here are some common examples of unlawful, infringing, inappropriate, or harmful content:

Content that infringes any of our intellectual property rights, our developers, or any other third party intellectual property rights;

Content that violates any applicable laws or regulations;
- Content that features pirated software.
